1. Acceptance of the present General Terms and Conditions
Every commercial order placed on the website www.Altawatt.com is subject to the prior acceptance of the present conditions. Only the General Terms and Conditions detailed on this page govern the transactions made between the company Altawatt and its clients who accept the whole content.
2. Conclusion of contract and price
Conclusion of the contract between Altawat and its client is done as soon as the client has finalized the transaction by authorizing the debit of its credit card on our financial partner website, or after final validation of its order form in case of cash on delivery.
2.1 Sending in France
Prices indicated on the website www.Altawatt.com are in Euros before tax and before carriage costs.
The total amount indicated on the order form includes carriage costs and VTA and correspond to the final price inclusive of tax, paid by the client during the validation of the order.

We draw clients attention to the point that depending on the destination country of the order, some customs duty and other tax may be charged to the client. These tax are supported by the client and of is under his own responsibility. Altawatt is not obliged to inform its clients about the applying tax in the destination country. We strongly encourage our foreign clients to apply to the relevant authority department of the destination country to inform themselves about the tax and customs legislation.
3. Commitments by parties
3.1 The client
· The client commits himself to provide to Altawatt true informations about his personnal data, billing address, delivery address and means of contact. In case of delay or incapability to deliver attributable to wrong provided data, Altawatt won’t be responsible of any prejudice. If additionnal transport costs were necessary, they would be completely supported by the client.
· Once the transaction finalized, the client commits himself to pay the total amount of the order.
3.2 Altawatt
· Altawatt commits itself to sell and organize the delivery of its client’s order into the 30 days following the payment date.
In case of unavailability of part or total of the order, in accordance with article L.121-20-3 from the french Consuming Code, the client will be informed and able to be refunded without delay, and at the latest into the 30 days following his order, from the total amount he payed.
· Altawatt reserves the right to cancel an order emanating from a client with who remains a dispute.
4. Information to consumer
The company Altawatt, via its website www.Altawatt.com commits itself, in accordance withe article L. 111-1 frome the french Consuming Code, to do all its possible to provide to its clients precise descriptions of all the goods it commercialize. This way, the custommer will be considered to be informed about the specifications of the good he wants to buy, and this before the conclusion of the contract.
However, informations and illustrations relative to each product being communicated by our suppliers, they are only given as an indication, and can not commit Altawatt’s liability in case of mistake which was not deteccted by our team during the control process.
5. Warranty
5.1 Delivery mistake
In case of a parcel’s delivery which doesn’t match the client’s order (quantity, product, not same specifications as on www.Altawatt.com ), Altawatt commits itself to replace or refund the concerned goods acording client’s wish.
Replacement or refunding of the goods will take place into a 30 days delay after Altawatt takes delivery of the return. Transport’s costs will be take in charge by Altawatt, and the transporter will be selected in agreement with the client.
Every good’s return has to be previously notifyed by the client to Altawatt, by letter or Email, in order to assign a return number to the parcel. The client has to take lot of care about the packaging in order for the goods to travel safely. The proof of transport costs and the return number will be joint to the parcel.
5.2 Product guarantee
As retailer, Altawatt does not provide any guarrantee on the goods it commercialize. The guarrantee relative to each product is the usual guaarrantee provided by the manufacturer. In case of defect which should be undertaken by the manufacturer’s guarantee, Altawatt will do its best to communicate to its client every informations which could help him in his approach.
All guarantee cover is impossible in case of dammages resulting from an installation or a use non in accordance with the manufacturer’s rules.
6. Delivery of ordered goods
The delivery will be done by a transporter selected by Altawatt. As soon as the parcel will be delivered to the transporter, the client will be informed by Email.
Altawatt is entitled to make partial deliveries.
During the delivery of the order, the client has to carefully examine the parcel in order to detect any marks of deterioration or opening. If the parcel presents some supect marks, the client is entitled to reject it. If he accept it, he will have to refer any complaints to Altawatt by registered letter at the latest 3 working days after delivery.
7. Privacy
All personal information of our customers will be treated confidentially. The transfer of such information to third parties who are not involved in the performance of the contract shall be excluded.
8. Right of Withdrawal
In accordance with article L. 121-20 from the french Consuming Code, the client has 7 days after the delivery of the ordered goods to withdraw. In this case, the client will be in charge to send back the material he doesn’t want anymore to Altawatt. Only the transport costs will be supported by the client.
The refund of the returned products will be made at the latest 30 days after delivery to Altawatt of the returned parcel.
To exercise his right of withdrawal, the client will be in charge to inform Altawatt by phone, Email or letter (postmarked) in order to obtain a return number which will be clearly written on the parcel. After obtaining his return number, the client has 7 days to send back the parcel.
9. Intellectual property
The all contents and structure of the website www.Altawatt.com are copyright protected under the laws defined by the french Intellectual Property Code. Duplication of the information or data, in particular the use of texts, text parts, images or logos is strictly forbidden.
10. Disputes – Jurisdiction – liabilities
The present General Terms and Conditions are governed by the French jurisdiction.
Any disputes concerning the execution or interpretation of the present General Terms and Conditions will be referred to the Tribunal de Commerce (Commercial Court) at Brive-la-Gaillarde in France.
In case of absolute necessity which involve an impossibility to handle the order of its client, Altawatt could not be considered as liable. Are considered as absolute necessity events (open-ended list) : partial or total strike in transports, customs problems, flood, fire, hurricane, earth tremor, war, riot, terrorist attack...
Altawatt won’t be considered responsible for any higher amount than the final price paid by its client. That way, no client will be able to demand to Altawatt any kind of compensation relative to a loss of earnings, rcognized or not, bound to a professional activity or not.
